Pricing
Pricing shown on the quote is good for 15 days unless otherwise specified on the quote page. Unless otherwise expressly stated, all prices exclude state, county and/or local taxes. Your tax rate will be calculated based on the delivery location of the product and added to the invoice unless a current tax exempt certificate is on file.
Credit and Terms of Payment
All accounts are COD or pre-paid unless credit has been applied for and approved by UNITED FIBERGLASS, INC accounting department. On open accounts, all invoices are due and payable 30 days from invoice date. Interest of one and one-half percent (1.5%) per month from the due date will be added to all accounts more than 60 days past due. Any products that have been ordered and are not delivered within 30 days of completion will be invoiced at that time with 30-day terms commencing from the invoice date.
Storage Fees
If after 30 days from completion of product, undelivered products may will incur a storage fee of $100 per day until which time the customer takes delivery of the products.
Freight and Delivery
All goods are sold F.O.B. shipping point unless expressly stipulated otherwise. In most cases, UNITED FIBERGLASS, INC will deliver and set the customer’s tanks on UFI's fleet of crane trucks. The price of setting is included in the delivery charge unless otherwise stated in the quote or order. Three (3) hours of crane time on location is included in delivery charge. If setting time exceeds 3 hours due to delays beyond United Fiberglass Inc. control, an hourly charge of $150/hr per crane truck will be applied to the invoice.
Return Goods
No UNITED FIBERGLASS, INC products or parts can be returned for credit unless consent of UNITED FIBERGLASS, INC in writing has been given in advance. Goods returned must be identified as to the original date of purchase and clearly show the shipper’s name and address. Goods not returned in salable condition may be subject to a deduction equal to the charges necessary to make the goods salable. This can be negotiated. Any freight paid by UNITED FIBERGLASS, INC will be deducted from the amount of credit granted.
Force Majeure
UNITED FIBERGLASS, INC shall not be liable for any failure to perform or delay in performance of this Agreement to the extent that any such failure arises from acts of God, war, civil insurrection or disruption, riots, government act or regulation, strikes, lockouts, labor disruption, cyber or hostile network attacks, inability to obtain raw or finished materials, inability to secure transport, or any cause beyond such party’s commercially reasonable control.
Claims
When goods are not delivered by UNITED FIBERGLASS, INC trucks and personnel, UNITED FIBERGLASS, INC is not responsible for goods lost or damaged in transit. Purchaser is solely responsible for filing claims against the carrier for any loss or damage. UNITED FIBERGLASS, INC will furnish all possible information, trace shipments to destination whenever possible, and render any other reasonable assistance requested to assist purchaser in filing his claim.
Warranty
UNITED FIBERGLASS, INC warrants its tanks to be free from defects in manufacturing, workmanship or materials for the period of one year from date of shipment. If a product or part should be found to be defective, notice should be given to UNITED FIBERGLASS, INC immediately. UNITED FIBERGLASS, INC will repair or replace at its sole discretion, within a period of one year after date of shipment, any tank proven to be defective. UNITED FIBERGLASS, INC reserves the right to inspect and test the defective item. The defective part should be retained until notice is received from UNITED FIBERGLASS, INC as to its disposition. Liability hereunder is limited to repair or replacement and does not include labor, installation costs, or indirect or consequential damages of any nature. The warranty obligations apply only when products or parts are used for the purpose and under the conditions for which they are intended, and in accordance with the best-accepted installation and operation practices and techniques.
UNITED FIBERGLASS, INC warranties apply only to goods manufactured by UFI. Goods not manufactured by UNITED FIBERGLASS, INC are warranted and guaranteed only to such an extent as these products and parts are warranted and guaranteed by the manufacturer or supplier of such goods and parts and then only to the extent UNITED FIBERGLASS, INC is able to enforce such warranty or guarantee. The foregoing constitutes the entire obligation of UNITED FIBERGLASS, INC , and there are no express or implied warranty of merchantability or fitness for any purpose whatsoever, except as stated above.
Miscellaneous
Where the customer requests special tests or inspections in excess of the regular factory inspections, the actual cost of such tests or inspections shall be charged to the customer unless prior agreements are made. UNITED FIBERGLASS, INC. is not responsible for non-delivery or delay in delivery due to delays, damages or losses resulting from strikes, riots, fires, floods or other accidents or occurrences beyond the control of UFI. Prices, specification and terms, as contained in any UNITED FIBERGLASS, INC catalog or bulletin, are subject to change without notice.
